01Acceptance of Terms

This Terms of Service Agreement (hereinafter "Agreement") is a legally binding document between you (hereinafter "User" or "you") and kvmmac Inc. (hereinafter "Platform" or "we") governing your use of the Platform's Mac cloud computing services and related features (hereinafter "Service"). Please read each clause carefully before using the Service, paying particular attention to provisions related to disclaimers and limitations of liability.

                                    By clicking "Agree", "Start Using", or any similar confirmation action, or by accessing and using the Service in any manner, you acknowledge that you have fully read and completely accepted all terms of this Agreement. If you disagree with any clause, please immediately stop using and exit this Platform.
                                

02Service Description & Changes

2.1 Core Service Description

The Platform provides users with cloud computing resource rental services based on real Apple Mac physical bare-metal machines. We reserve the right to make reasonable adjustments to service features, content formats, technical specifications, or delivery methods at any time based on actual operational needs.

2.2 Service Continuity

We will make every effort to maintain stable and continuous service operation, but cannot guarantee permanent availability or zero downtime. You acknowledge that brief interruptions may occur due to network fluctuations, natural hardware wear, routine system maintenance, and other objective factors. The Platform's liability is governed by the Service Level Agreement (SLA) signed by both parties.

2.3 Third-Party Component Integration

The Platform may integrate plugins or functional modules provided by third-party partners. The Platform makes no warranties of any kind regarding such third-party external services and assumes no joint or incidental liability.

03Account Registration & Security

3.1 Registration Requirements

You warrant that all information provided during account registration and subsequent use is true, accurate, complete, and continuously valid. You are solely responsible for any losses arising from providing false information or failing to update account details in a timely manner.

3.2 Credential Protection

You are obligated to keep all account login credentials safe, including but not limited to usernames, passwords, and SSH keys and other sensitive data.

                                    All operations initiated through your account credentials are deemed to be authorized by you, and you bear full legal responsibility. If you discover any abnormal login or unauthorized access, please contact us immediately and take appropriate action.
                                

04Fees & Payment Terms

4.1 Payment Model

The Platform operates on a prepaid model — users must pay in full before service activation. All plan prices are listed in USD and are pre-tax amounts. Users are responsible for declaring and paying any taxes arising from use of the Service in accordance with applicable local laws.

4.2 Refund Policy

Except as otherwise required by applicable law, all fees paid by users are non-refundable, including account balance top-ups and purchased but unconsumed service time. The Platform reserves the right of final interpretation of this policy.

4.3 Price Changes

The Platform reserves the right to adjust service pricing at appropriate times. Any price changes will be communicated to users in advance via platform announcements or account notifications. Renewals are billed at the current price in effect at the time of renewal.

05User Code of Conduct

While using all Platform services, you must comply with all applicable laws and regulations. The following behaviors are strictly prohibited:

Violating any laws, regulations, or regulatory requirements of any applicable jurisdiction;
Infringing on others' copyrights, patents, privacy rights, or other legally protected interests;
Sending spam, conducting phishing, or engaging in any form of online fraud;
Performing unauthorized port scanning, network penetration testing, or distributing trojans or malicious code;
Engaging in any form of cryptocurrency or digital asset mining (unless expressly authorized in writing by us in advance);
Excessively consuming or deliberately abusing platform computing resources in ways that affect other users' normal use.

Upon discovery of any violation, we reserve the right to immediately suspend or permanently terminate your service access without prior notice, delete relevant data without refund, and pursue legal liability as permitted by law.

06Data Rights & Management

6.1 Data Ownership

All data you upload or store on the Platform's servers remains entirely your property. The Platform makes no claim of any kind over your data content.

6.2 Data Backup Obligations

                                    Users are solely responsible for backing up and protecting all their data. Even if the Platform provides auxiliary backup tools, such features are optional add-ons and do not constitute any express or implied warranty of data integrity or security by the Platform.
                                

6.3 Personal Data Processing

You agree that the Platform may lawfully collect, store, and process your personal information in accordance with our Privacy Policy.

07Disclaimer of Liability

The Platform's services are provided "as is" and "as available", without warranties of any kind, express or implied.

To the maximum extent permitted by law, the Platform expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet all your business expectations, nor that the Service will operate uninterrupted, respond instantly, be fully accurate, or be error-free at any time.

08Limitation of Liability

In no event shall the Platform, its affiliates, directors, employees, or partners be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages (including but not limited to loss of business profits, data loss, or business interruption), even if the Platform has been advised of the possibility of such losses.

To the maximum extent permitted by law, our total liability to you (whether based on contract, tort, or any other legal basis) shall not exceed the total service fees you actually paid to the Platform in the one month prior to the dispute.

09Service Suspension & Termination

9.1 User-Initiated Termination

You may stop using all or part of the Platform's services at any time, but fees already paid are non-refundable.

9.2 Platform-Initiated Termination

If we have reasonable grounds to believe you have violated any provision of this Agreement, we reserve the right to suspend or permanently terminate your access to the Service at any time without incurring any liability. Upon termination, the Platform may immediately delete all data and records you have stored on the Platform's servers.

10General Provisions

10.1 Governing Law & Dispute Resolution

This Agreement shall be interpreted, governed, and enforced under the laws currently in force in the jurisdiction where kvmmac is incorporated. Any disputes arising from this Agreement shall be submitted to the competent court or arbitration body in the place of incorporation.

10.2 Severability

If any provision of this Agreement is found to be illegal, invalid, or unenforceable, that provision shall be severed as an independent and separable part, and the legality, validity, and binding force of all remaining provisions shall remain unaffected.

10.3 Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the Platform's services and completely supersedes all prior written and oral communications, representations, and understandings between the parties on the same subject matter.
